Who We Are

These Terms apply to services provided by CACAO MOBILE SPOLKA Z OGRANICZONA ODPOWIEDZIALNOSCIA (KRS 0000920978) (“Company,” “Cacao Mobile,” “we,” “us,” or “our”), a company registered at 00-511, ul. Nowogrodzka, 31/414, Warsaw, Poland. BrainZan is a brand of Cacao Mobile.

Eligibility

By using the Services, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement.

Description of Services

BrainZan provides an online IQ-style test covering logic, memory, numerical, spatial, verbal and attention skills, a personal results report, and short daily brain-training games. The test and the report are available on brainzan.com, and access to the full report and training is provided through a paid subscription purchased by card on brainzan.com.

BrainZan is designed for self-reflection and practice. It is not a clinical, psychological or diagnostic assessment, and its results must not be used for medical, educational, employment or other decisions about a person.

Account Registration

To use the Services, you may need to provide an email address and create an account. You agree to:

• Provide accurate and complete information
• Keep your login credentials confidential
• Be responsible for all activity under your account
• Notify us immediately at [email protected] if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions and Billing

We may offer a paid introductory trial to new users. At the end of the trial, your subscription will automatically convert to a paid recurring subscription at the applicable rate unless you cancel before the trial period expires. Trial offers are available to new subscribers only.

We may change subscription prices. We will provide advance notice before any price increase takes effect, as set out below.

Web subscriptions (payments by card on brainzan.com)

This section applies to BrainZan subscriptions you purchase by card on brainzan.com.

• Introductory trial: your subscription starts with a 3-day trial for $0.99 USD (€0.89 EUR), charged today.
• Automatic renewal: unless you cancel, your subscription renews automatically at $39.99 USD (€34.99 EUR) every month until cancelled. The first monthly charge is taken at the end of the 3-day trial, and further charges are taken once a month on the same day.
• Statement descriptor: charges appear on your card statement under the descriptor shown next to the payment button.
• Consent: before you pay you must tick two boxes, one accepting these Terms and our Privacy Policy and one accepting the billing terms shown next to the payment button. We keep a record of this consent (time, IP address, email, the version of the checkout and the version of these Terms).
• Emails: we send all subscription emails from [email protected], including a confirmation when your subscription starts, a reminder before the trial ends, a receipt for every charge and a confirmation when you cancel.
• Price changes: we will not change the price of an active web subscription without emailing you at least 7 days before the new price applies. You can cancel before that date and you will not be charged the new price.

How to cancel

You can cancel at any time:

• Follow the instructions on our cancellation page.
• Email [email protected] from the address you subscribed with.

Cancellation stops all future charges. Your access continues until the end of the current paid period. If you cancel during the trial, you will not be charged the monthly price.

Refunds

Refunds for web subscriptions are handled in accordance with our Refund Policy.

Acceptable Use

You agree to use the Services lawfully and in accordance with these Terms. You must not:

• Violate any applicable laws or regulations
• Reproduce, sell, or exploit any part of the Services, including test questions, without our written permission
• Reverse-engineer, decompile, or disassemble the Services
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to any part of the Services
• Use automated tools, bots, or scrapers to access the Services

Intellectual Property

All content, features, and functionality of the Services — including test questions, puzzles, text, graphics, logos, and software — are owned by Cacao Mobile or its licensors and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use only.

Results Disclaimer

Test scores, percentiles and reports are estimates based on your answers to an online test. They may be inaccurate, are not comparable to a supervised IQ assessment, and do not measure your worth or abilities in any absolute sense.

Privacy

Your use of the Services is subject to our Privacy Policy. For data-related questions, contact [email protected].

Third-Party Services

Payments are processed by third-party payment providers. The Services may link to third-party platforms. We are not responsible for the content or practices of third-party services, and your use of them is subject to their own terms.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CACAO MOBILE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR REVENUES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

Indemnification

You agree to indemnify and hold harmless Cacao Mobile and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

Changes to the Services and Terms

We may modify or discontinue the Services at any time. We may also update these Terms. We will notify you of material changes by posting the updated Terms on brainzan.com with a new version number, and by email for subscribers. Continued use after the effective date of changes constitutes acceptance.

Termination

We may suspend or terminate your access to the Services at any time if we determine that you have violated these Terms or if termination is necessary to protect the Services, other users, or third parties.

Governing Law and Jurisdiction

These Terms are governed by the laws of Poland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland, without prejudice to your statutory rights as a consumer under applicable local law.
